In a recent development, the National Institutes of Health (NIH) has announced a newly revised categorization for basic experimental studies involving humans (BESH). As per the agency’s announcement on January 29, BESH applications will not be subjected to clinical trial requirements effective from May 25, 2026. However, there remains an expectation for such studies to comply with all relevant clinical research laws, regulations, and policies. This shift in protocol is part of the NIH’s ongoing efforts aimed at reducing administrative burdens.
The new definition posits that clinical trial research is characterized as producing health-related biomedical or behavioral outcomes with the potential for directly advancing health welfare. BESH research, while valuable in potentially informing future health advancements, does not necessarily aim at changing clinical practice. As such, according to NIH, these exploratory studies do not fit the established definition of a clinical trial.
In light of this newly revised categorization, the NIH has announced that it is currently reviewing existing systems. In due course, the agency aims to put forth further guidance to help effectively assess whether a study can be classified as a clinical trial under this revised framework.
